Excerpt from Sources of Our Liberties: Documentary Origins of Individual Liberties in the United States Constitution and Bill of RightsThe purpose of this book is to present in a single usable volume the historic documents constituting the major legal sources of our individual liberties. As Mr. Perry, the editor, says in his introductory note to the text of Magna Carta on page 1: "The liberties of the American citizen depend upon the existence of established and known rules of law limiting the authority and discretion of men wielding the power of government."The United States Constitution and Bill of Rights assert the existence of certain of these liberties as part of the fundamental law on which our government rests. But these great documents are not the only original sources. The rights there stated were established through generations of conflict and struggle. The great drama goes far back into English and American political history. It appears and reappears in documentary form, step by step, sometimes years apart, in royal concessions, in legislation, attempted legislation, popular compacts, colonial charters - all culminating finally, for the American citizen, in the Declaration of Independence, the Constitution and the Bill of Rights.Believing that too little is known of the solid foundation on which the structure of our individual liberties has long stood, the Committee on American Citizenship of the American Bar Association recommended that the major documents be re-examined and published as a single volume. The task was assigned to the American Bar Foundation, the research affiliate of the American Bar Association. This book is the result.The Foundation was fortunate to secure the services of Mr. Richard L. Peny, now of the District of Columbia Bar, to direct the research project and to act as editor.
